Alliance Defending Freedom regarding Amendment 3.
Alliance Defending Freedom is a conservative Christian legal advocacy group that works to defend Christian religious liberties & who regularly argues cases before the U.S. Supreme Court.
Amendment 3 seeks to enshrine a right to “reproductive freedom” into Missouri’s constitution but fails to accurately inform voters of the potentially dangerous scope of the term “reproductive freedom.” Amendment 3 defines “reproductive freedom” as “the right to make and carry out decisions about all matters relating to reproductive health care, including but not limited to” abortion and contraception. The intentional use of the phrases “all matters” and “but not limited to” creates ambiguity that could be used by Missouri courts to interpret Amendment 3 to include a “right” to other medical procedures such as sterilization, assisted reproduction surrogacy, removal of healthy reproductive organs, and the provision of cross-sex hormones and other harmful chemicals that alter the normal functioning of the male and female body.”

Under Amendment 3, the “right” to reproductive freedom would be conferred on every “person.” This means that anyone, including a minor (male or female), would have a “right” to abortion, contraception, sterilization, and other procedures including the removal of healthy reproductive organs. Parental involvement in these procedures could be seen as denying, interfering with, delaying or restricting a minor’s constitutional “right” to “reproductive freedom as created by Amendment 3.
